Welcome to PostFuel! These Terms of Service ("Terms") govern your use of the PostFuel API, website, and related services (collectively, the "Service") provided by [Your Company Name/Your Name] ("PostFuel", "we", "us", or "our"). 1. Definitions
- "Service" refers to the PostFuel API, website, documentation, and any associated software or services.

- "API" means the Application Programming Interface provided by PostFuel for fetching and generating content.
- "User Content" means any data, prompts, URLs, text, or other materials submitted by you to the Service.

- "Source Credentials" refers to API keys or other credentials provided by you for accessing third-party services (like Currents, SerpApi) via the Service.
- "PostFuel Credentials" refers to API keys generated within the Service for accessing the PostFuel API itself.
- "Credits" refers to the usage units required to perform certain actions via the API, managed according to your Subscription Plan.
2. Account Registration and Use
You must register for an account to access most features of the Service. You agree to provide accurate and complete information and keep your account information updated. You are responsible for maintaining the confidentiality of your account password and PostFuel Credentials and for all activities that occur under your account.
You must obtain your own API keys or credentials for certain third-party data sources (like Currents, SerpApi for Google Events) if you wish to use those sources via the Service ("Source Credentials"). You are responsible for complying with the terms of service of those third-party providers.
3. License Grant
Subject to your compliance with these Terms, PostFuel grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the API and Service according to your Subscription Plan and credit balance.
4. Acceptable Use Policy
You agree not to use the Service to:
- Upload or generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Infringe upon any third party's intellectual property rights, including copyright and trademark.
- Attempt to reverse engineer, decompile, or otherwise discover the source code of the Service.
- Transmit viruses, malware, or other malicious code.
- Interfere with or disrupt the Service or servers/networks connected to it.
- Attempt to bypass credit limits or security measures.
- Violate any applicable local, provincial, national, or international law.
PostFuel reserves the right to investigate violations and suspend or terminate accounts engaging in prohibited activities.
5. User Responsibilities Regarding Generated Content
5.1. Review and Verification: You acknowledge that Generated Content is produced by artificial intelligence models and may contain inaccuracies, errors, biases, or reflect viewpoints that do not align with yours or PostFuel's. **You are solely responsible for reviewing, editing, fact-checking, and verifying all Generated Content for accuracy and suitability for your intended purpose before any use, publication, or distribution.**
5.2. Copyright and Originality: You acknowledge that AI-generated content can be similar to existing works or content generated for others. PostFuel does not perform plagiarism or copyright infringement checks on Generated Content. **You are solely responsible for ensuring that your use of Generated Content complies with all applicable copyright laws and does not infringe on the rights of any third party.** You agree to perform your own due diligence regarding originality and necessary rights clearance before using Generated Content, especially for commercial purposes.
5.3. Compliance and Moderation: You are responsible for ensuring that both your Input Material and the final use of any Generated Content comply with the Acceptable Use Policy (Section 4) and all applicable laws and regulations. PostFuel does not guarantee the filtering of all potentially harmful or infringing content.
6. Fees, Payments, and Credits
Access to certain features and usage levels of the Service requires a paid Subscription Plan and the use of Credits. Details of plans, credit allowances, and credit costs for API actions are available on our Pricing page. Fees are billed in accordance with the terms specified at the time of subscription via our third-party payment processor (Stripe). Credits are typically assigned monthly upon successful subscription payment and expire or reset according to the plan terms. Unused credits are generally non-refundable. You are responsible for all taxes associated with your subscription.
7. Intellectual Property
You retain ownership of your original Input Material and your Source Credentials. Subject to your compliance with these Terms and the terms of any underlying third-party AI model providers (e.g., OpenAI), you own the rights to the specific Generated Content created for your account. You grant PostFuel a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Input Material solely for the purpose of providing the Service to you. PostFuel retains all rights, title, and interest in and to the Service itself, including all underlying software, technology, and documentation.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. POSTFUEL DOES NOT WARRANT THAT THE SERVICE OR GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSTFUEL, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY GENERATED CONTENT OBTAINED FROM THE SERVICE, INCLUDING ANY ERRORS, OMISSIONS, OR INACCURACIES THEREIN; (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL POSTFUEL'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU PAID POSTFUEL, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to defend, indemnify, and hold harmless PostFuel and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your Input Material or your use of Generated Content caused damage to a third party.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, typically via email or a notice on our website. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
